TERMS AND CONDITIONS

The MOTORHOME RENTAL AGREEMENT WITHOUT DRIVER provides the following, which the Lessor and the Lessee, jointly referred to as the “Parties,” agree to.

Article 1 – Object

The Lessor leases to the Lessee, who accepts, the motorhome described below:

Article 2 – Duration

The rental period runs from [START_DATE] ([START_TIME] hours) to [END_DATE] ([END_TIME] hours) for a total of [N_DAYS] days.
Extensions must be requested in writing at least 24 hours before the expiration date and are subject to the Lessor’s acceptance.

Article 3 – Fee, Deposit, and Guarantees

1. Total fee: € [TOTAL FEE], including 100km/day.
2. Payment method: 50% upon booking, balance due 7 days before pick-up.
3. Security deposit: €600 in cash or by bank transfer; this amount covers damages, fines, penalties, and additional costs.
4. The Lessor is authorized to charge any amount due under this agreement.

Article 4 – Delivery and Return

1. Delivery to [DELIVERY_LOCATION] on [DELIVERY_TIME] with a full tank of fuel, a clean water tank, and a clean interior.
2. Return to [RETURN_LOCATION] on [RETURN_DATE_TIME]; 60-minute grace period, after which a €100/hour charge will be applied.

6. with toilet emptied and waste water tank empty.
7. Flat-rate costs in the event of non-compliance:

Art. 5 – Vehicle Use and Restrictions

1. Exclusively for tourism and recreational purposes; passenger transportation for profit, competitions, and unauthorized towing are prohibited.
2. Sub-leasing or transfer to third parties is prohibited without written consent.
3. Driving abroad is permitted only with the Lessor’s prior written authorization and with additional insurance coverage.
4. Driving while intoxicated or under the influence of drugs is prohibited; compliance with the Highway Code and weight/height restrictions is mandatory.
5. Winter: From November 15th to April 15th, the Lessee must have snow chains or winter tires on board.

Art. 6 – Additional Drivers and Age Requirements

1. Minimum age for the main driver: 23 years old with a valid license for at least 24 months.
2. Each additional driver must be indicated in this contract.

Art. 7 – Insurance Coverage and Optional Services

1. Coverages included:
2. Maximum liability insurance;
3. 24-hour roadside assistance for breakdowns not attributable to the Renter;
4. Driver accident insurance.
5. Specific exclusions: damage to the roof, underbody, interior damage, glass and accessories not covered, damage to the vehicle attributable to the driver.

Art. 8 – Accidents, Thefts, and Malfunctions

1. The Renter is required to report any accident, theft, vandalism, or breakdown within 24 hours by completing the CAI form and contacting the Lessor.
2. The Lessor may, at its discretion, provide a replacement vehicle subject to availability; any transportation costs are the responsibility of the Renter, unless additional coverage is provided.

Art. 9 – Routine Maintenance and Equipment

1. Periodic checks of oil, water, tire pressure, and windshield washer fluid are the responsibility of the Renter.
2. In the event of a punctured tire or replacement of light bulbs, the costs are the responsibility of the Renter, unless additional coverage is provided.
3. The vehicle may be inspected by the Lessor, subject to 48 hours’ notice.

Article 10 – Cleaning, Fuel, Mileage

1. Extra cleaning penalty (smoking, excessive dirt): €50 [EXTRA_CLEANING_PENALTY].
2. Km beyond the 100km included: €0.20/km.
3. Loss or damage to keys/remote control: €150;
4. Loss of electrical cables or accessories: €100.

Article 11 – Fines, Tolls, and Administrative Fees

1. All traffic violations, tolls, and parking fees are the responsibility of the Lessee.
2. The Lessor will charge €10 (in addition to the fine) for the administrative management of each ticket.
3. The Lessor may automatically charge these amounts to the credit card provided.

Article 12 – Cancellation and Withdrawal

1. Cancellation more than 30 days before pick-up: full refund minus €37 handling fee.
2. 30-15 days: 30% penalty; 14-8 days: 50% penalty; 7 days or no-show: 100%.
3. The Tenant may withdraw after pick-up, but the rent remains due for the entire booked period.

Article 13 – Failure to Return, Misappropriation

After the 24-hour return period has elapsed without notification, the Lessor may file a complaint for misappropriation pursuant to Article 646 of the Italian Criminal Code, without prejudice to the right to compensation for further damages.

Article 14 – Loss of Tenant’s Property

The Lessor is not responsible for items left on board. Any items found will be held for 30 days. After this period, they will be considered abandoned.

Article 15 – Privacy (EU Regulation 2016/679)

Personal data will be processed exclusively for purposes related to the execution of this contract and retained for the period required by law. Detailed information is available in the attachment.

Article 16 – Applicable Law and Jurisdiction

This contract is governed by Italian law. Exclusive jurisdiction: Bari, Italy, unless otherwise specified for consumers.

Article 17 – Specific Approval Clause

Pursuant to Articles 1341-1342 of the Italian Civil Code, the Tenant declares that he or she has read and expressly approves the clauses set forth in Articles 3, 4, 5, 6, 7, 8, 10, 11, 12, and 13 of the Italian Civil Code.
